This Rental Agreement (“Agreement”) is entered into by and between the Cabin Owner
(“Owner”) and the Guest (“Guest”) for the short-term rental of the Misty Mountain Cabin
located at 6 Bucks Walk, Black Mountain, North Carolina 28711.

BY COMPLETING YOUR RESERVATION YOU ACCEPT ALL OF THESE TERMS AND CONDITIONS.

Payment Terms
  • Booking dates are secured upon receipt of 50% of Subtotal shown in cost
    breakdown and a signed rental agreement.
  • The balance of the Grand total shown in cost breakdown must be paid in full no later
    than 30 days prior to check-in.
  • A refundable security deposit of $500 is required and must be paid with the final balance. Deposit will be waived if damage insurance is elected. See  House Rules Section for more details and conditions that may affect refund eligibility.
  • The deposit will be returned within 3 days of check-out, pending inspection and
    provided all check-out procedures are followed.
  • Deductions may be made for:
    • Excessive cleaning required
    • Damage to property or furnishings
    • Violation of house rules (e.g., smoking, unauthorized pets, exceeding
      occupancy)
  • Deposit will be returned via the original payment method (Paypal).
Occupancy
  • Maximum occupancy is 9 guests, excluding children under the age of 4.
  • Exceeding the occupancy limit may result in immediate termination of the rental without a refund.
Pet Policy
  • Pets are welcome with a $75 pet fee per stay.
  • Pets must not be left unattended in the cabin unless safely crated.
  • Bathing pets inside the cabin is not allowed. If plumbing is clogged due to pet hair, the Guest will be charged for plumber services.
House Rules

Please help us care for the cabin by following these guidelines:

  • No smoking or vaping inside the cabin, on decks, or porches. The natural log absorbs odors, and violations will result in a minimum $350 professional cleaning fee or the invoiced cost of a smoke and fire restoration specialist, whichever is higher.
  • No candles are allowed inside the cabin.
  • No parties or events are permitted.
  • Quiet hours are from 10:00 PM to 8:00 AM. Please be mindful of neighbors.
  • Follow all posted signs and rules, including those at the fire pit.
  • Hot tub: No glass allowed. If any glass is accidentally broken, please inform us immediately to avoid fees.
    • In the unlikely event that the hot tub is inoperable (e.g. jets not working, failure to heat above 95℉) under normal conditions, the Guest is entitled to a $50/night refund upon request for the duration of the issue.
    • Guest is responsible for alerting Owner at first instance of issue. Refund only applies after Owner has been made aware issue exists and troubleshooting has been performed.
  • Toliet: Only flush toilet paper. Use the provided sanitary bags for all other items (e.g., tampons, wipes, paper towels).
  • Pets: Do not wash pets indoors – this can clog drains and result in plumbing fees.
    Use the outdoor hoses located on each side of the cabin.
  • Food & Trash:
    • Do not leave food, drinks, or coolers unattended outside, especially on the lower back patio or upper decks – this attracts wildlife.
    • All trash must be bagged, tied, and placed in the cans labeled trash in
      the bear-proof enclosure near the propane tank. Ensure it is securely closed after use.
    • A recycling bin is provided in the laundry room, should the Guest fill the bin,
      there is a designated recycling can in the bear-proof enclosure.
    • Please do not place trash in the recycling can.
  • Books & Snacks: Feel free to enjoy the snacks and take a book home! Please don’t
    take anything else – we’re happy to share where items were purchased.
  • Please respect the property. Guests are responsible for any damage beyond
    normal wear and tear. You have the option to purchase a damage insurance policy
    as outlined below:
    • Damage insurance would be purchased through the Owner via the third party
      Waivo® under one of the following tiers:
      • $39.00 for $1,500.00 coverage
      • $59.00 for $3,000.00 coverage
      • $79.00 for $5,000.00 coverage
    • Any costs exceeding the policy limits are still the responsibility of the Guest.
    • Damage insurance may be elected up until 5:00 pm the day of check-in with payment made directly to the Owner at time of election.
    • Damage insurance is non-refundable.
    • The Guest may request the detailed contract to review the terms, coverage, exclusions and services of the agreement.
    • By opting to not purchase this damage insurance, Guest assumes all costs related to damage occurring during the period of the stay.
Check-In
  • Standard check-in is at 4:00 pm
  • Early check-in is available upon request, subject to availability
  • Entry code for smart lock will be provided on day of check-in and activated at check-in time.
  • To unlock the door, enter the code provided then press the check mark button.
  • To lock the door, simply press the Yale logo button. An audible tone confirms the
    door locked successfully.
Check-Out
  • Standard check-out is at 10:00 am
  • Late check-out is available upon request, subject to availability
  • Towels: Place used towels in the tub or hang them – just not on the floor.
  • Dishes: Wash or load and run the dishwasher (hour cycle).
  • Beds: No need to make them – leave unmade.
  • Hot Tub: If used, close the cover securely.
  • Trash: Tie and place full bags in bear-proof bins by the propane tank—no loose
    trash.
  • Kid Gear: Clean and put away any kid items. Leave out pack ’n plays or cribs for us to deep clean.
  • Blankets & Linens: Leave out any extras you used so we can launder them.
  • Appliances: Clean and put away any small kitchen appliances used.
  • Food: Remove all open and perishable food items. Feel free to leave condiments
    and unopened non-perishable food items (e.g. ketchup, box of mac-n-cheese,
    canned goods, frozen pizza, etc.).
  • Broken Items: Please let us know if anything broke – especially glass near the hot tub – so we can ensure the safety of all guests.
  • Please lock all doors and windows upon departure.
Cancellation Policy
  • 100% refund if the reservation is canceled 30+ days in advance, or if the canceled
    dates are re-booked by another guest.
  • 50% refund if canceled 14–29 days before check-in.
  • No refund if canceled less than 14 days prior to check-in and the dates are not
    re-booked.
  • If the cabin is re-booked, a full refund will be issued regardless of cancellation
    timing.
Force Majeure
  • Neither the Owner nor the Guest shall be held liable for failure to perform any part of this Agreement due to events beyond their control, including but not limited to: natural disasters (e.g., hurricanes, floods, wildfires), government actions, pandemics, travel restrictions, power outages, or other acts of God.

In the event that such circumstances prevent the Guest from occupying the cabin during the reserved dates, the Owner will offer one of the following options, at their discretion:

    • Full refund of any payments made, or
    • A credit toward a future stay of equal value, subject to availability.

  • This clause does not apply to cancellations due to personal reasons or weather conditions that do not result in official travel restrictions or evacuation orders.
